By creating an account and using Qala Software ("Qala", "the platform", "the service") at qalasoftware.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.
These terms constitute the entire agreement between you and Qala Software regarding your use of the service.
Qala is a cloud-based quantity surveying software platform that enables construction professionals to create and manage estimates, programmes, applications for payment, variations, and related documentation.
We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

You retain ownership of all data, content, and information you enter into Qala ("your data"). By using the platform, you grant us a limited licence to store and process your data solely for the purpose of providing the service.
We do not claim ownership of your data and will not use it for any purpose other than operating the platform. See our Privacy Policy for full details.
Access to Qala may require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are stated inclusive or exclusive of VAT as displayed at the point of purchase.
We reserve the right to change our pricing with at least 30 days' written notice. Continued use of the service after a price change constitutes acceptance of the new pricing.
Refunds are not provided for partial billing periods, except where required by applicable law.
The platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.
Qala is a tool to assist with quantity surveying tasks. All estimates, programmes, and financial figures produced using the platform are the sole responsibility of the user. We accept no liability for any financial decisions, contract values, or commercial outcomes that result from use of the platform.
To the maximum extent permitted by law, Qala Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the service.
Our total liability to you for any claim arising out of or relating to these terms or the service shall not exceed the total amount paid by you to us in the 12 months preceding the claim.
You may cancel your account at any time from within your account settings. Upon cancellation, your access to the service will continue until the end of the current billing period.
We may suspend or terminate your account immediately if you breach these terms, or if we are required to do so by law. Upon termination, your data will be deleted in accordance with our Privacy Policy.
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms of Service from time to time. We will notify you of significant changes by email or by displaying a notice within the platform. Continued use of Qala after changes are posted constitutes your acceptance of the updated terms.
